What is a Legionella Risk Assessment

A Legionella Risk Assessment is a systematic inspection of a property’s water systems to identify conditions that may encourage the growth and spread of Legionella bacteria.

The assessment considers how water is stored, distributed and used throughout the building, together with factors such as water temperatures, system design, usage patterns and maintenance arrangements.

During a Legionella Risk Assessment, the assessor will typically review:

• Hot and cold water systems

•Cold water storage tanks

• Water heaters and calorifiers

• Pipework and outlets

• Little-used outlets

• Water temperatures

• Areas where water may stagnate

• Existing control measures and maintenance procedures

Frequently Asked Questions

Is a Legionella Risk Assessment a legal requirement?
Yes. While no single piece of legislation states that every property must have a Legionella Risk Assessment, duty holders have a legal responsibility to assess and manage the risk of exposure to Legionella bacteria wherever water systems could present a risk.

This duty arises under the Health and Safety at Work etc. Act 1974 and the Control of Substances Hazardous to Health (COSHH) Regulations 2002. The HSE’s Approved Code of Practice, ACOP L8, sets out the recognised standard for meeting that duty, and carries special legal status of its own: following it demonstrates compliance, and departing from it means you’d need to show you’ve met the duty by another route. HSG274 provides the supporting technical guidance on how to apply L8 to specific types of water system.
Legionella Risk Assessments should be reviewed regularly, typically annually, and whenever there are significant changes that could affect the water system or its level of risk. This may include alterations to the building, modifications to the water system, changes in occupancy or following the identification of issues that could increase the risk of Legionella growth.

Legionella Risk Assessments are commonly required for commercial buildings, offices, schools, healthcare premises, hotels, leisure facilities, rental properties, residential buildings with shared water systems, and supported housing and social accommodation. They’re also required for other premises where water systems could present a risk of Legionella bacteria developing.

Supported housing and social accommodation are a particular focus area, as regulators including Ofsted, the CQC and the Regulator of Social Housing routinely request evidence of a current Legionella Risk Assessment as part of their inspections and registration requirements.

If Legionella is found in your water system, it doesn’t automatically mean people have been exposed or that your building needs to close. However, it does mean you should take action as soon as possible.

The next steps will depend on the level of bacteria detected and the type of water system. This may include flushing the system, disinfecting pipework, removing areas of stagnant water, adjusting water temperatures, and carrying out follow-up testing to confirm the issue has been resolved. Your Legionella risk assessment should also be reviewed to identify why the bacteria developed and ensure your control measures remain effective.

Taking prompt action helps protect building occupants, maintain compliance with your legal responsibilities, and keep your water system safe.

The responsibility usually sits with the Duty Holder. Depending on the property, this may be the employer, building owner, landlord, managing agent or another person with responsibility for controlling the property’s water systems. The Duty Holder is responsible for ensuring Legionella risks are assessed and managed appropriately.

You may need one, especially if you don’t have an up-to-date asbestos register. For buildings built or refurbished before 2000, asbestos should be presumed to be present unless there is strong evidence otherwise. This is particularly important when maintenance or refurbishment could disturb hidden materials. An Asbestos Survey can establish what is present, where it is and its condition, giving you the information needed to manage the risk.
